LUMA NUVÉ ONLINE STORE TERMS AND CONDITIONS

 

§1 General Provisions

  1. The online store operating at: https://lumanuve.world is run by the owner of the LUMA NUVÉ brand, Service Group Sp. z o.o., VAT ID (NIP): 6653004466, e-mail: sekretariat[at]servicegroup.pl (hereinafter referred to as the “Seller”).
  2. The Seller may be contacted at: shop@lumanuve.world.
  3. These Terms and Conditions define the rules for using the Store, placing Orders, concluding Sales Agreements, and the rules governing delivery, complaints, and returns.
  4. Each Customer making a purchase is obliged to read these Terms and Conditions.

§2 Definitions

TERMS AND CONDITIONS – this document.
STORE – the online store available at https://lumanuve.world.
CUSTOMER – a natural person, legal entity, or organizational unit making a purchase in the Store.
CONSUMER – a Customer who is a natural person making a purchase not directly related to their business or professional activity.
ENTREPRENEUR – a Customer making a purchase in connection with their business activity.
PRODUCT / GOODS – movable items offered in the Store.
ORDER – a declaration of intent by the Customer aimed at concluding a Sales Agreement.
SALES AGREEMENT – an agreement concluded between the Seller and the Customer via the Store.

§3 Conditions of Using the Store

  1. Information presented in the Store does not constitute an offer within the meaning of Article 66 of the Polish Civil Code, but an invitation to conclude a contract (Article 71 of the Polish Civil Code).
  2. Product prices are provided in the selected currency (PLN or EUR) and include VAT if applicable according to the place of delivery.
  3. Prices do not include delivery costs, which are indicated during the ordering process. For international deliveries, additional customs duties and local taxes may apply. Such charges are determined by the relevant authorities and are payable by the Customer.
  4. Browsing the Store assortment does not require account registration.

§4 Technical Requirements

In order to use the Store, the following are required:

  • Internet access
  • An up-to-date web browser
  • An active e-mail account
  • Enabled cookies and JavaScript support

The Seller shall not be liable for disruptions resulting from failure to meet the above technical requirements.

§5 Placing and Processing Orders

  1. Orders may be placed via the order form available in the Store.
  2. To place an Order, the Customer selects a Product, adds it to the cart, provides the data necessary for Order fulfillment, and selects the payment and delivery method.
  3. Before finalizing the Order, the Customer is required to accept these Terms and Conditions.
  4. Placing an Order constitutes an offer to conclude a Sales Agreement.
  5. The Agreement is concluded when the Customer receives an e-mail confirmation that the Order has been accepted for processing.
  6. Ownership of the Product transfers to the Customer upon full payment being credited to the Seller’s bank account.
  7. If payment is not received within 14 days of placing the Order, the Order may be cancelled.

§6 Payment Methods

The Seller enables the following payment methods:

  • Online payment systems available in the Store.

Order processing begins after payment has been credited.

§7 Delivery

  1. Delivery is carried out within Poland, the European Union, and selected countries outside the EU.
  2. Delivery costs are indicated during the Order process.
  3. For international deliveries, additional customs duties and local taxes may apply. These charges are determined by the relevant authorities and are payable by the Customer.
  4. The standard lead time is 8–10 weeks, unless stated otherwise in the product description.

§8 Complaints

  1. The Seller is obliged to deliver Products free from defects.
  2. The Seller is liable for non-conformity of the Product with the Sales Agreement.
  3. Complaints should be submitted electronically to: shop@lumanuve.world.
  4. The Seller will respond to complaints within 14 days of receipt.
  5. If the complaint is accepted, the Seller may propose repair, replacement, price reduction, or refund.

§9 Right of Withdrawal

  1. A Consumer has the right to withdraw from the Agreement within 14 days of receiving the Product, without giving any reason — this applies only to standard (non-customized) products (see section 4).
  2. To exercise the right of withdrawal, a statement must be sent to: shop@lumanuve.world.
  3. Refunds will be issued within 14 days of receiving the withdrawal notice. The Seller may withhold the refund until the returned Product has been received.
  4. The right of withdrawal does not apply to products made to individual order or manufactured according to the Customer’s specifications.

§10 Personal Data Protection

§11 Copyright

All content, photographs, descriptions, and graphic materials available in the Store are the property of the Seller and are protected by law. Any copying or use without written consent is prohibited.

§12 Final Provisions

  1. These Terms and Conditions are governed by Polish law.
  2. Any disputes arising from the execution of the Agreement shall be resolved by the competent court in accordance with applicable law.
  3. The Seller reserves the right to amend these Terms and Conditions. Amendments shall not affect Orders placed before the effective date of such changes.
